The Real Estate (Regulation and Development) Act, 2016 has paved the way for Indian States to establish Real Establish Regulatory Authority and their Rules and Regulations for an efficient regulation of the real estate sector.

The Supreme Real Estate Law in India is the RERA Act 2016 followed by the State Rules, Regulations and notifications and the Court orders.

Below is the synopsis of the legal purview of the Indian Real Estate Sector.

State Regulations under RERA – A Legal Understanding

Section 84 of the RERA Act provides that each State Government will make rules for implementing the provisions of the Act within 6 months of the Act being enforced. Subsequently, the State Government will notify the said Rules.

For five Union Territories without Legislature viz., Andaman & Nicobar Islands, Dadra & Nagar Haveli, Daman & Diu, Lakshadweep, and Chandigarh, the State Government has released the Real Estate (Regulation and Development) (General) Rules, 2016.

As of 2022-2023, Meghalaya, Arunachal Pradesh, Sikkim and Nagaland have not notified the Rules. In these five north-eastern states, the RERA Act is facing certain constitutional challenges as the land in those states is community owned. However, Indian State West Bengal has notified a similar Act called the West Bengal Housing Industry Regulatory Act, 2017, which came into effect from 01.06.2018.
